The purpose of this question is to see if an ex-employer is saying negative things about me.

yes it is ok to do it is against the law for the former empolyee to say bad things about you.

I'm afraid you're not going to like my answer. Don't do it. Smart HR professionals should only confirm dates of employment; saying anything else can always be taken out of context and could result in a lawsuit. They are a "former employer" for a reason--it wasn't working for someone or both of you. Whatever negative things that you think they are saying about you, just do better in your next job. Move on and count it as a learning experience. Why do you care what they think anyway--you don't work for them anymore!
