It depends on your state. Most states do not require a license but it's always an added bonus as it reassures parents.
1) You'll need decide whether you can/want to do this out of your own home or buy/lease a specific facility.
2) Study the competition / other daycares in your area and see if there actually is a demand!
3) Check the requirements and get license (call the city / county / state for that) if you can.
4) Advertise a few weeks before the opening to ensure you'll have children from the start.
5) Open your daycare (you'll need enough supplies / toys / furniture...)

To find parents who require daycare, you'll need to advertise a bit. Luckily, markegint is pretty easy nowadays:
A) Tell everyone you know about it (and tell all your local shopkeepers if if possible)
B) Make and print a few flyers (use your favorite word processing software and use a few clip arts) and pin them to all the bulletin boards you can find (gym, church, ...)
