i have some legal papers and it read as the following please help me understand what it is saying and where to find more info on it....

Permitting the Parties to utilize the discovery procedures delinested in the West virginia Rules of Civil Procedure pursuant to W.VA. R. Prac. & Pro. For Family Law 11 because the nature of the parties' inancial situation and the facts pertainent to a proper allocation of parenting functions require addintional discovery to permit a full and fair presentation of the evidence; And, such other further relief as the court may deem.

i am not sure what that all means and need a little help with fully understanding it.. i am not wanting to bash her father but i do have a full time job and i am supporting her with out the finical help from him since he chooses to pay a lawyer so please help me under stand this all and also where can i find this law "W.VA. R. Prac. & Pro. For Family Law 11 " i did a yahoo surch and was unable to find it please help

the beginins of it states the parenting plan which will give me codisty of the child and the second part is childsupport and medical coverage the third oart is what i have listed above... as far as a lawyer.. they are asking for 4000.00 just to help me and i work full time but all the money that i am makeing is going to my child and for her needs.i have sent my own parenting plan for this case matter it is what the court house sent me to be able to do on my own..

also west virginia legal aid is not an option they was unable to help me due to me not being on public aid... kinda nuts i am avoiding being on public aid to keep him from useing it against me

Discovery is a procedure that is used in the legal system that allows each side to find out more information about the other side's position. Depending on who wrote this, it could have different meanings. If it came from the father's attorney, it most likely means that the attorney is arguing for the court to allow discovery in this case in order to help determine how custody should be distributed. They are probably trying to get access to your financial records to make an argument that you don't earn enough money to support the child alone.

I know it's expensive, but if I were you, I would retain an attorney immediately. There is nothing good that is going to come out of you going up against a person that is represented by an expert unless you have one of your own.

It sounds like the court is requiring more information to determine a reasonable amount of child support. Such as, a visitation agreement and both parties' income information. If I were you I would contact your local Legal Aid office. Your local domestic violence shelter should be able to provide you with the phone number and tell you about the application process. You need an attorney.

Go to your state's statutes and look up that particular code for the specifics, but it means that both parties are entitled to discovery in the proceeding. That means, records subpoenas, witnesses, expert witnesses, depositions, subpoenaing financial information, etc., etc. Everything investigated in a case to put it together and present it to court.
