My lunch is 30 mins. I've been taking a 35-40min lunch since the day I started because I come in 20 mins. early everyday. My boss has never said anything to me about it. Now all of a sudden he's counting every minute over and writting it down. Do you think this is fair?

Hell no! I have no idea why bosses do this mess! It kinda/sorta worked against me when i worked at Compuware. My manager accused me of taking longer lunch breaks than usual when it really wasn't the case. If he takes petty stuff like this into consideration and overlooks your work performance (was it good?), then he has the problem, not you. Ain't nothing wrong with finding something else if problems continue to escalate.

When you come early in the morning, are you clocking in? If so, some people call this milking the clock. Lots of bosses do not like this, so you better have a talk with your boss and get this all checked out. He's the boss, not you! I know you have it all worked out in your mind, but no one else knows this. So, before your unemployed, get it straightened out!

Maybe he isn't aware that you come in early. You don't want there to be a gap in your understanding versus his understanding, so sit down and tell him that you noticed that he seems to be concerned about this. And that you were making that time up by coming in early. Ask HIM if he thinks it's fair because he holds the strings to keeping your job or not.

If it were me I would just start writing down every minute that you come in early.

Mmm...I would talk to him/her about it; perhaps your boss doesn't want to sure you are trying to steal time...
