When we moved in to our current place, we did the walk through to check for anything that was wrong with the place already. We were never provided with a copy of the deficiencies list, only the lease. A couple months back, I contacted my landlord to ask for a copy of the list so I'd have something to reference while we were returning the property to its original condition. He told me that shortly after we moved in, he totalled his car and lost many documents, our deficiencies list, being on of them. We will obviously do our very best to clean the house and get it into 'move in' condition. We even decided to not hang any pictures so we didn't have to repair nail holes. My question is.......If our landlord claims that the place was better before we move, but doesn't have any written documentation to support that, how am I suppose to approach him with that without being rude?

FYI. We moved in March 2005, so we've been here about 2 years. I never noticed I didn't the list until recently when we found out that we'd be moving soon.

you could take pictures, mail them to yourself and not open it unless you later need to. I had to do that. My landlord tried to hold our deposit. We had lived in the townhouse, it flooded and he got his insurance to cover the replacements, but we had taken pictures previously. When we tried to move, he tried to keep most of our deposits and we told him we had pictures of the place of when we moved in. we never had to show him. he knew. I would imagine it would be hard for the landlord to also prove his case without proof.

I have several rentals, if he finds a problem, chances are you both know who is at fault and their isnt confrontation. In any case he has no power without his documentation, its not about being rude, its business, he knows that

Take pictures with the date on the pictures before you move your stuff in, then when you move out, take pictures again. The pictures will be your evidence

Call him back and ask him to come over and do a new one for you. That way it will reflect what is there today and you have less chance for problems.
