It depends. Are pets allowed on the property, or did the rental agreement explicitly state that pets were not allowed? If the latter, then PERHAPS the dog owners are liable. However, if the landlord was aware that one of the tenants maintained a dog on the property, in violation of the rental agreement, and did nothing about it, then it is possible that the landlord is partly liable. The landlord would be liable if she knew or should have known that the dog was capable of causing injury, and that such injury to another party was foreseeable.

If the dog was maintained on the property in violation of the rental agreement, and the landlord did not know of the dog, and had no way of knowing that the dog brought a risk of injury to a third party, then the dog owners are liable.

If dogs were allowed on the property, and the landlord knew or should have known that the dog brought a risk of injury to a third party, but did nothing to eliminate the risk, then the landlord is partly liable.

It depends. Was the tenant keeping the dog legally--in other words, was the landlord aware of the pet being there - was it mentioned in the lease? Was the dog properly restrained, or had it gotten loose? In these cases, the liability would be on the shoulders of the tenant. If the dog was restrained and the landlord knew it was there, there is a little room for the possibility of liability on the part of the landlord-but still the main liability is on the person taking care of the dog.

Actually yes depending on the dog , new york state does & your homeowners insurance will consider you liable for any injuries cause by a pit bull or any large dog considered to be at risk like chows,pitbulls,mastiff,bulldogs,rotweillers, are not covered and homeowners & tenets can be sued

If the dog is owned by the tenant renting it is the tenants responsibility if their dog bites someone, not the property owners.

Why is it that people always want to blame people that are not involved but have money. Why not just the person that has the dog? forget everyone eles. Or the person that allowed the dog to injury them.
