My ex adopted my children after their real father signed away his rights to avoid child support. My ex and I have been divorced for six years. He did not have a job at the time we divorced and was trying for disability. He was supposed to pay me back support and send monthly checks when he received his disability. I have not seen anything. I can't afford to hire an attorney, but thought about going through the child support enforcement program. Do you think I should or just let it drop? My daughter is now 23 and my son is 17. The years of supporting them on my own has left my credit in shambles. Any advice? I feel a little selfish since he did adopt them, but I also lost any chance of getting any support from their natural father.

With a 23 year old daughter you should not be getting anything for her...the son maybe...if the court decree awarded you child support. If not...tough.

Even after your children have become adults he still owes you money for when they were children. He can't just wait it out like a statute of limitations or something. His liability for additional support ends at 18, but not his liability for money owed.

If your child support payments were court ordered, you should contact the state and get ahold of the child support folks. They will give you the best advice on how to help them get you the money owed you, even if your ex moves out of state.

Even if your child support arrangement was privately agreed they may still be able to help.

The child support enforcement administration is a JOKE and a waste of your time.

Trust me. I had to go in yearly to re-fill out paperwork. I gave them his home addy, work addy, ss#, pictures of him, phone numbers, etc and they did NOTHING but ask me three years in a row to come re-fill out the paperwork. BS!

Your best bet would be to file the paperwork with the courts and have it garnished from his wages. There should be online worksheets and such on your government website. There is a filing charge, but it will hopefully be worth it. Try something like Child Support form and then the name of your county. Might take a little hunting.

You should absolutely try to get it. Go through the Attorney General and you will not have to pay for a thing. He took on the legal responsibility by adopting them. That was his choice and he should be held accountable for it. Good Luck!

Don't let it drop this is money your children are entitled too! He owes it he has to pay he took that responsibility when he adopted the kids. Sounds like you could really use the money to help with the credit cards. Go for it!

At this point it's kind of moot, isn't it? The thing about legal stuff is that there is a huge amount of emotional energy that goes into it. If you are willing to fight and fight and fight with him then go for it. You would probably be better served at this point by just doing the best you can to clear off your debts and rebuild.

go straight to the district attorney and talk to him... you don't have to pay a lawyer for this one.

1st of all what is the relationship between them and him?
2nd how is your relationship with him?
once you see were you stand you will know yourself if you should or if you shouldn't.
