in addition to the old question, did they only suspend habeas corpus, or the entire 5th amendment??

The president can do ANYTHING he wants under the Executive Order.

If you research all the executive orders you'd be surprised what many presidents have done.

Remember many are classified "Top Secret" so you will be hard pressed to find out about some of them.

But basically the president can do anything he wants.

Take a look at some of the ones Kennedy signed.
And Clinton
and Bush
and Regan

I think the white house web site has the ones that are not top secret on there.

Its called martial law. When in an emergency or war, the govt. can suspend anything it wants to.

Now here is the beauty of this administration:

They claim that we are fighting the "War on Terror". That war doesn't have a defined enemy and therefore won't have a defined end. So.... you can keep this war going indefinitely and since we're always going to be at "War" then this emergency state that exist can give the govt. the excuse to curtail any freedoms they want to.

Very smart on the administration's part...very devious

Amendments can only be "suspended" if the constitution says they can be suspended.

Lincoln suspended habeus corpus during the Civil War. The constitution said that he could.

The terrorists at Gitmo are not US citizens and thus have no right to habeus corpus.

It's possible if you get 3/4 of Congress to approve and the President to sign off on the change without a veto.
