Since Anna left her entire estate to her (now deceased) son Daniel, will his next of kin be able to obtain her estate as their own?
If so, who would be considered Daniel's next of kin? His sister or his father?

A deceased person cannot inherit anything and therefore in the case of Anna Nicole's will which named a now deceased Daniel as the heir, he could not inherit anything. There are also the problems that exist with the current will because there were quite a few contradictory paragraphs in it, such as one sentence saying it would "disinherit" any future spouses and/or children, yet further in the same paragraph it would award monies to a future child. The will will probably be declared null and void. This will mean that Anna Nicole essentially died intestate- without a will. All proceeds will then go to her next of kin, her daughter Dannilyn. This is why, I personally think, Howard K Stern is holding on to her so tightly. She is the "cash" calf and he will be S.O.L. without her.
Daniel's father would not be a consideration because:-
1) Daniel predeceased his mother so he never inherited anything for his father to be able to try and claim
2) The will , I think, will just be nullified which will also mean nothing could go the father in any event.

Only if the father turns out to be someone ELSE that hasn't come up yet.
Personally, I find so much of this story to be so off the wall that I wouldn't be a bit surprised if it turned out the father of that baby was noneother than Anna Nicole's son DANIEL!

i think that all her assets should be put into a trust fund for her only living child. Her mother and Howard should not be able to touch any of it. There should be a DNA done to find out who is the biological father and only that man should have custody of the baby. I guess some of the money should be used to help raise the little girl. Anna should be buried next to her son.

Even though Anna left nothing to children born after her son Daniel I still think she is entitled to it because of Daniel's death! And she is the only child left to get what remains of her estate or added to it from J Howard Marshall's family!

His next of kin was his mother and baby sister. When his mother passed it went to his baby sister OR Howard Stern IF he can prove they were married in international waters, which is LEGAL. Then he becomes her husband by law and can continue the court case to get the money owed her in the previous marriage.

I never thought about Daniel's father, now wouldn't that just be a strange twist of fate. Is he still alive? I wonder. Very good question. I just thought his sister would get everything (still she probably will).

Her Daughter will ....Hopefully the Courts will reach a decision in the next 18 YEARS lol... That poor little girl will be in court for a long time once she hits 18...
