I had a car crash acouple weeks ago and i have been signed of work for over a month now with a bad back,

I have been with my company over 4 years , can they sack me because iv had this time off ?

NO. With a capital NO. You can take them to court if they sack you as long as you don't let the sicks note run out.

If you are in the Uk they cannot just sack you for being off sick. However, they are entitled to ask to see you and also ask for a doctor's report if you continue to be off sick. The reason behind this is that your employer is entlted to know whether you will ever be returning to work - obviously you can't be sick forever and they may want to check what the prognosis is. If it looks as if you are going to be unable to return to work wihtin what they consider to be a reasonable time, they can start dismissal proceedings, but there are steps they have to go through and you have a right to representation. It depends on where you live. If you live in the US, You may qualify under the FMLA (Family medical leave act) or long term and short term disability insurance.

FMLA is a government law, and long and short term insurance is an employer "benefit" .

That doesnt stop an employer from sacking you, because as you know some employers are unscrupulous. If that occurs, I would definitely file for unemployment.

as far as I'm aware they cannot sack you while your on the sick ,however should the period of sickness or illness go on for a long time with you being unable to work in the foreseeable future they can ask you or force you to medically retire ,but it sounds like your a long way off that .
if you have a union have a word with them or even phone the jobcentre or citizens advice bureau it may set your mind at ease .

I wouldn't have thought so - depends on your company - some are very high handed, if they try you can always go to the Tribunal. If it helps I've been on sick leave for ll years and my company's insurance doctor agrees I am not fit for any type of work now.

they cant Sack you ,but they do have a right to send you to a doctor for a second opinion, if they are paying you sick pay.
They do have the right to make pay you after a certain period and put it down to "frustration of contract"

No they cannot sack you as you have proof that you need that time off, if they do decide to do it then you cantake legal action against them for unfair dismissal

I'm a relief worker and been of for nearly a year after a car crash they are now saying thy cant keep me on for any longer i superpose it depends on your job. try talking to cab citizens advise berue (not sure of spelling)

If they sack you they are almost certainly doing something illegal and so you will have a course of action to take should they do that.

Yes, they can fire you if you do not go through the necessary steps required by the company. For instance, they can demand that you see their company approved doctor to verify your condition. If you refuse to do that, then they can terminate.
