The teacher can not just take a pen or anything and not have a reason. Then even with the reason he would have to give the item back and it may be not allowed in his class again for some reason but he can't take your private property.
Just explain this to your teacher calmly and if he does not respond in a positive manner you will have to go to your guidance counselor and then if the GC don't help go all the way up to the Principal of the school telling them that a teacher has taken private property. By the way if the pen had a questionable picture or slogan on it ...this may be the reason..or did you bop someone in the head with it? well...there must have been some reason but if the answer is he just took it away...well then you probably have a case. If he took it by accident (was helping you or something and then just pocketed it), just tell him he accidentally took it and that you'd like it back.

If he took it because he thought you were using it to misbehave (clicking it incessantly) or doing something you shouldn't, then acknowledge the behavior that lead him to confiscate it, tell him you'll change the behavior and ask for it back. If he's reasonable (and most people are) then he'll give it back. Then hold up your end of the deal.

If he took it for NO reason and won't give it back even after you asked nicely for it, then suck it up and deal with the loss, or involve your parents or the principal.

I think to solve your problem, i need to know why your teacher took your pen away. My handphone was confiscated once and my solution was to ask the friend closest to the teacher, or maybe that teacher's pet and then asked her to do me a favour and beg the teacher for the hanphone. True enough, the teacher believed my friend and she gave it back to me.

Why'd she take it from you? Was something about it causing a disruption in class? Was there something inappropriate about it?


Try asking for it back; and if that doesn't work, ask her if there is some way you can earn it back. It's a pen, though. You should be able to get another one just like it.

Tell her it's a pen that means a lot to you. Tell her that it is very sentimental and that your dead Grandfather gave it to you and it's the only thing you have left of him

Show that you can be an adult and politely ask for it back after class, apologizing for whatever you did to get it taken away. Manners are important!

Threaten to file a petition in the magistrate court.

Naturally, you would have to have the pen provided for photographs, lab analysis, etc.

Be sure to keep filing for extentions so that you don't have to return it. ;)

see if it's in their draws. and take it back wen there's like recess/lunch of go to class early and take it. i'm sure he/she won't mind..after all..it is just a pen.
