My husband was in a bad place 4 years ago, and he did not show up for court when his ex was petitioning for him to sign away his rights to his daughter. I he almost done paying the back child support that he owed. He keeps thinking that he wanted to be there to see his daughter, is it too late for him, as far as legally? The bad part about this is his ex wife works for a family law lawyer, so she gets free legal aid, we dont have the money for a lawyer, is this a lost cause? Please help!! She is 8 years old. The mother says that when she is ready for a relationship with her father, probably when she is a teenager, and ready to take on the responsibility of a mental relationship with him, then thats when they can have a relationship, but who knows how long that will be. She does not want us sending her gifts for her birthday or Christmas, or even letters, not to confuse her. Does ANYONE have any advise?

I don't think so.
He's paying so he should have some rights.

Look in your yellow pages for a free legal aid service - they are out there.

If your boyfriend is to poor for a lawyer - then he should try his best to stay in his exwifes good graces. Just because he gave up his parental rights, doesn't mean he should not have anything to do with his daughter. On the contrary. If he doesn't send letters, cards, gifts, etc....His daughter will grow to hate him. Or be very upset and never,ever get over that he didn't try to communicate with her. He'd better start soon. If he has the monies almost up to date--should tell his exwife and his daughter that he does care. You may be able to find a lawyer-probono-. I do know that most lawyers will have a consultation - free. That's when you find out who will or can help you. But stay in touch with your daughter OR you will definately regret it. You should try to sit down and talk with your ex if you can. Don't let her use that child like a pawn. Go to an attorney and get some advise.

It may be difficult to get visitation rights since he gave up his parental rights, but I don't believe that the mother has the right to deny him from having any contact from his daughter. You might want to check www.fatherrights.com for information on possibly getting a lawyer over this. If nothing else, he should at least be allowed have contact enough to let his daughter know that he hasn't abandoned her.
