Wife is choosing to not sign sale agreement that we have with a buyer, wife wants us to go into foreclosure. The agreed divorce papers just state to sale asap, but I cant see any judge accepting what she is doing is ok. She is refusing to sign the documentation to start the sale process. The foreclosure is a week or two away. Is there any legal way to force her to sign, or any legal way I can get a judge to authorize me to be Power Of Attorney for the purpose of completing this deal. The divorce paperwork state she gets 50/50 of the sale of the condo, so its not like I am trying to take her money. What legal right do I have to by pass my wife signing these documents the condo can sale and be done with it!??

Seeing you get the shaft means more to her than the money. Sucking up works better than force.

If the papers say that the sale should proceed asap then go back through the legal process immediately and don't wait until people like me post answers. Do it now

Get the purchase offer in writing and a copy of the divorce decree and send it to the judge. By not signing the papers she is in contempt of court and could be thrown in jail until she complies.

Call your lawyer and let him/her handle this. That's what he/she gets paid for. Have him get in front of a judge immediately to show that what your soon to be ex wife is doing is retaliation for the divorce.

You will need to take her to Court again. There is no other way that is legal and won't get you into trouble. Sometimes the other half doesn't care about the money. She is mad & just wants to make your life miserable.

If it's in the divorce papers just take her to court. She will be told to abide by the divorce agreement or they'll put her in jail. Simple as that.

Hope you have a great lawyer. Call them now and let them know. Let the lawyer handle this that is what you paid them for. It is part of the divorce.
