my dad is a truck driver, his truck was standing at the truck stop, and so anothers people's truck..(wife and husband were the owners of it and both were inside) the lights of the other persons truck were all off. My dad accidently bumped their truck, there were no scratches on the (couples) truck, but there were some on my dads..the (couple) told my dad to pay them 300$ and police wont b involved..my dad agreed, he gave them his insurence and company name, but they didnt give him anything. it was a slight bump..NOW THEY are sending a law suit for $10000, and they claime that they got back and head injuries and were savier, and both of them needed mecical treatment..the accident happened in 2004 and they just put all the papers and filed them to us ?? what to do??

Your dad is insured. Such a claim will be covered by insurance, which will pay for your dad's defence as well as any resulting damages. Your dad may pay higher premiums. Call the insurer and report the accident. Do this NOW if you haven't done it already. If the people told your dad that they would take $300 and that would be the end of it (no police, no law suit, etc.) and if he paid them, then you can raise "accord and satisfaction" as a defence. That means the case has already been settled and paid, so they can't sue.

Telling someone you will call the police if they don't pay you money is known as blackmail or extortion. You may want to report this to the police.

Well, from what you say, there really isn't a whole lot you can do. Your dad is screwed because he was stupid. He needs to hire an attorney NOW to mitigate the damages. The attorney might be able to dig up something on the couple, like a history of this kind of crap, or other things to submit as evidence that will help your dad. My bet is that your dad will lose. However, his insurance company should be the one to get an attorney for him. He should call his insurance company immediately!

Sounds like insurance fraud to me. Tell the insurance company about this immediately and let them handle it. It may be necessary to get a lawyer. He/she will respond with an appropriate letter. The statute of time limitations may have run out; in any case, tell your Dad not to ever hand anybody cash in a situation like this. Often the courts see this as an admission of guilt. It's so sad that people are so greedy they will do anything for a buck. Best of luck to your Dad.
