i am so sorry to tell you this but the judge might say that that does not make him a bad parent and he has to be a bad parent for him to lose custody

No. My ex husband cheated on me and even moved in with the woman then snatched my daughter from the babysitter and went to court to ask for custody and was awarded temporary custody. The judge did not give a crap that he was with another married woman who had also left her husband.
I spent 18 months in court and finally was awarded custody of both kids after a home study was performed by a child welfare agency who told the judge what a scamming liar my ex husband was.
I was convinced the ex and his new girlfriend were going to end up with my daughter. Almost happened except I had a good social worker.

The fact that a person cheats makes them a crappy spouse, but it doesn’t make them an unfit parent. A judge will not even take it into consideration at all, UNLESS the cheating in some way had a direct effect on the children (ie a parent left their small children unsupervised while they went off to have sex with their lover).

you can get a divorce because he cheated but custody is another story all together in most states the mother gets the children its almost a given in my home state

Nope, I don't think anyone can get sole custody these days....You
don't want that anyway....You want to have joint Physical and Legal, with You as the Primary Parent.

In most states the Mother is given physical custody of the kids you wont be able to keep him from getting visitation ,In most states if you can prove adultery you are usually granted alimony ...Hope this helps

yes you can probably... you can also use the mitochondria card, you gave that to your child and u r the mother, so you should be able to as long as ur stable, and working. Good Luck, I hope that helped!!!
