The surname Mountbatten-Windsor will only be used by descendants of the Queen and Prince Philip who are not princes or princesses or who do not have a different name from their father (like Peter and Zara Philips). Therefore Charles's name, legally, is Windsor though it's not really a practical issue as he has no cause to use one.
