Yes. As long as it remains an indictment only and isn't turned into actual charges.

The length of time depends on the State involved and it's statue of limitation. Statue of limitations says the state has x amount of time to decide to charge your or not. BUT if you are charged with that x amount of time, the warrant for your arrest never expires.

If you came across the border and got shot(maybe) by border patrol then dont worry the feds will stick up for you.
