If i get a paternity test done and my dad is not my dad will my mom have to pay back child support? the man on my birth cirtificate is supposidly not my dad and i would like to have a paternity test done but i am curious if i would have to pay back all the child support from over the years if it turns out to be true

if he signed the birth cert. and gave you his last name, then he took parental responsibility. He can't reneg it now. Even if he is not your biological dad, he was the one who took the financial and moral burden, of his own accord. I don't think she'll have to repay.

I dont think so. If the man on the birth cerf signed off as being the father at the time of birth he is accepting financial support for the child. If a dna test is done and he is not the father he can ask for the $$ back but I dont think he can. I would always consult an attorney to be on the safe side. If your mom perpertrated a fraud that is her problem. No matter how much you love her.

She can be glad I don't write the law, if a MAN can go to jail for NOT paying child support a WOMEN should have to go to jail for lieing on a Birth Certificate and not notifing all potential fathers.

That is just evil in my book.

depends.

if he is the only father you ever knew (the only father figure) probably not. some states have laws on the books that are the father figure if they were married and the only father the child ever knew. some have laws on the books about the name on the birth certs.

depends; upon what state you live in.
