I work in a small office in NJ where there is a no smoking indoors law. It's just me - a nonsmoker, my boss - a smoker, and another guy - a smoker. The problem is the two smokers don't care about the law. I told them the smoke really bothers me and I would like if they go outside to smoke, their version of going out is standing by the door, with the door cracked. What's really bad is that right by the door there is a vent that sucks in air for the heating and cooling system, so if they are smoking the smoke gets sucked in and recirculates, making the office smell for hours. But they say they do not smell anything. Also, if I am not in the office they smoke in there and when I come in there are ashes everywhere and it smells bad. When I bring this up to them they say that they don't smoke around me, or when I am in the office.

I am affraid if I report this and the business gets fined they will know that it was me who reported them and I will risk losing my job. What should i do?

They are risking YOUR health you need to put a stop to it NOW! Talk to them if that doesn't work tell them your going to put in your 2 weeks if it doesn't stop them then they obviously dont appreciate you and you should quit. If you feel like you've been wronged enough you could complain to your local employment agency or even sue them. Remember that its not just an annoying habit but its a risk to your health to!

if ur boss is the owner, then you are out of luck, u can sue them for a hostile environment and for OSHA violations, plus your health code violations, but if you really wanna keep your job, that probably wont work, honestly, if they dont respect your wishes now, they probably wont ever and it may just be best to move on to a new company.

sounds like its time to start looking for a new job. cigarette smoke is nasty and overtime it will seep into your clothes and just not go away. its terrible that these people aren't more respectful about it. probably just time to move on to someplace that actually acknowledges the laws and codes pertaining to smoking.

I agree. Time to move on. Maybe the get the message when you give them your resignation. If not, they aren't worth wasting your talent and health on. Good Luck.
