I have many scratches on it and would just prefer to get a new phone (same version) without any scratches or exterior damaging. If I go to Cingular will they let me do this? If not, what can I do or say so that they will let me?

Depending on the type of scratches and phone damage, if you try to get a new phone through warranty, they may charge you full price for the replacement phone. It may be considered physical damage.

They will say to you "didt you read the instructions? On page 1 it tells you to use a second skin or a replacement case or a holder on it to prevent scratches, and the care section tells you how to take care of the screen properly. The device is still functioning."

In general, you can spiff up your old cellphone by replacing all the plastic and glass on it with a color replacement kit. Go here for a good site that has a lot of them available:

Tell them u lost it accidently and get a new one, althoug it is going to cost u 50 bucks.
