i am doing this because my partner has come to no financial agreement with me and it is taking to long and i can not afford to rent anymore

Absolutely. It's your property as well legally.
And, if you have a proportionate mortgage, which a lot of people dont realise they actually do have because it's a part of most mortgages anyway, if you you move back in, and discover your portion is larger than her's, your in more legal right than she is and get tell her to pack her bags unless she stumps up an equal amount to your payments.
Most people will tell you that it all depends cos of the kids etc.
But if your actuyally living in the house then the only concern about the childrens welfare is the roof above there head, which they already have.

Well. it will depend on very much of the divorce settlement.

Technically speaking you can but the aggro will be too much. The eventual winner will be lawyers.

Jst speak to you ex and explain the situation. It will be cheaper on the long run for the both of you.

It is important to get our the speration as soon possible and then look at the reality of the situation and sort things aout between the two of you. At all cost avoid the sharks....crook lawyers

Yes I think you will find that you can move back in. if it is the marital home she is not legally allowed to change the locks and you are allowed to have access to the property at any time until the divorce money terms are sorted out.

If your name is on the deeds to the house, then there is no reason why you can,t move back in. Might be a bit uncomfortable for you both, bringing back partners etc, but you are entitled to stay there, till things get sorted out properly

I expect you lost that right the day you walked out, or allowed her to throw you out you should never have left the matramonial home, just be a bit slow and tight with her maintainance money... she'll soon have a rethink!.

unless there is an injunction preventing you from doing this you have occupational rights over the matrimonial home. if you are not yet divorced you are totally entitled to go back
