B. But it depends on state law. Generally, if the person on the receiving end is put "in reasonable fear of imminent harm" that is an assault.

So - if I say, "do that again and I will kill you," that is not an assualt because it is not imminent. The person can choose to not "do that again." It might be a threat, but it is not an assault.

Also, if a 5 foot weakling with no violent past or physical training says to Mike Tyson "I'm going to beat you up right now!" It's imminent, but not "a reasonable fear," since Tyson would not reasonably be in fear of injury.
