In some states, never. My state does not recognize common law marriages unless they are entered into in another state that does recognize common law marriages. The length of time varies from state to state, but five to seven years is common. However, just living together is not enough. You have to "hold yourself out to the community" as husband and wife. I'm not sure what that entails since you can't enter into a common law marriage in my state. Hopefully the other people can help you more. You do need to tell us what state you live in, though.

That depends on what state you live in, and if that state even recognizes common-law marriages.....most don't. In California for instance it is 7 years.
