Check your employers policies. They might have a requirement that a doctors note is needed when you miss X number of days in a row. If your company has this policy, and you were made aware of it, then no it is not illegal to ask you in for a meeting. They might be informing you that you have missed quite a bit of work and that they will be placing you on probation (this is where that doctors note would come in handy). Since they are waiting a week before they talk with you, I doubt that they will let you go.

If you have previously had a lot of sick leave, your employer is entitled to check that you are going to be well enough to return to work and that you do not have some on-going illness or incapacity which may prevent you from carrying out your duties. On the other hand, your employer should not hassle you while you are off sick - its a fine line. Suggest you have a Union rep or clued up friend with you during the interview, although if they have not said its a disciplinary hearing, it may just be a fact finding visit.

Take a look at the company policy on sick leave AND short term disability. Some companies may require either a doctor's note for sick days over 3 consecutive days, and if serious enough, it may require that you file for short-term disability. It all depends on the company policy though.

Yes, it is legal for the H.R. manager to ask to see you at any time. Read your employee handbook to see what the company policy regarding use of sick time, what is the reporting procedures for calling in sick, and how much time you are allowed. Did you need to bring in a doctor's note according to your policy and did not? He/she may be giving you paperwork for FMLA leave to fill out to protect your job (if it applies to your company and work site). Go and see what it is they want to talk to you about.

Do you have a contract? If so, read the part about sickness and missing work, did you violate it? If so then yes. If you have no contract? They can do anything they want as long as it doe's not violate company policy which should be in writing and you should have a copy of it.

They can ask to see you any time they want. If your trying to imply that they are not allowed because a week has passed that's ridiculous. You could have done something last month and be asked about it now. There is no time frame. You just have to deal with not knowing what they want for a week.

If you have not adhered to the company policy for sickness then yes they can.
I suggest you read your contract of work and pay attention to the Sickness part.

if you are still officially off sick and they are asking you to come in while you are off.........no I don't think that's right - if they need evidence of your sickness you need to get a doctors note, photocopy it and post it to the HR manager.
