Okay so, our rent here is $1195 and our deposit is $1100 If we paid the extra wouldnt we beable to use that as our Last months rent?
It does state in the lease that it cannot be used, but what would happen if we did? I mean would he evict us or something? If so, doesnt that take up to 30 days to do anyhow? We would be outta here by March 31 which is the end of our lease... Im wondering because our landlord is a d**khead and we know that we wont see a dime of our deposit back, because of outragous charges... The last place we were in under him... he was going to charge us for the cleaning of the oven and stove, the fireplace and the picking up of all cigarette butts... those at $1 a butt!!! We know that he will come up with more things to charge us for.... So please any legal help would be greatly appreciated...

well, as far as I'm aware that's why you pay your security deposit - so that you could use it as a last month rent. If not - then where is this money going to?

If you do that, the landlord can file against your credit for failure to pay your rent. He can also file for judgement in court, which he would win, too. You made an agreement with the landlord, you cannot break it without consequences.

It sounds like you are the d---head. You rented from him before, so if he was unfair or improper, you knew better by now. You expected him to clean the oven, stove, fireplace and your cigarette butts after you? Of course he charges you! His labor is worth something too. Besides if the charge is $1 a cig butt to pick up, how come your charges were more than $0?

Some places will ask for first month, last month & a security/cleaning deposit. In that case, the "last month" depost can be used as you described, but only if it was specified as as "last month" deposit.

Your security deposit, is meant for any expenses such as cleaning, painting, carpet cleaning, etc. that may need to be done after you have moved out. Then any remaining funds will be returned to you.

And yes, if you try to use your secutiry deposit as your last month's rent, you will hurt your credit and may end up getting a 3-day notice if your rent is late, but it will also put you without a place to live AND no chance of any part of secutiry deposit being returned.

That's the same as not paying your last month's rent, and your landlord will send the unpaid bill to collections. He may also have the right to keep your security deposit even if you eventually pay the unpaid rent. Pay your rent and you will get your security deposit back--unless of course you've done damage or otherwise violated your lease.

You can try to do that but he may in turn sue you for the rent, calling it unpaid rent and showing an eviction on your rental record. I would pay it, take pictures of the way that you leave the place, let him know that you left it better than you got it and you have the pictures to prove it and I bet you get most of your deposit back. I did that and got ALL of my deposit back
