Its a new home and when the dug for the electrical and sewer they damaged the roots. Not sure if it will come back or not. Its very old
and tall.

an oak tree as old as that unless they hit the tap root i dont think you have anything to worry about the tap root goes straight down from the center of the tree and this root is its main source for water and food bee in the nursery for 20 years

Watch for new growth as spring marches on then check occassionally by scratching the bark to see if there is green beneath.
If it is brown, or when you snap a trig it is brown and dry inside - not good sign.
But you never know - I would give it a chance to come.
Pick up some root stimulant ( from your garden centre) and water the roots liberally. Keep in mind that the feeder roots will be away from the trunk, under the drip line of the tree.

If you can reach the branches, find a small branch and scrape a little bit of the bark. If there is a green layer under the bark, but on top of the wood, the tree is living. You may want to try this in several different areas.

If you wait until the tree leafs out, you'll know without having to get into the bark.

parts of it may die off but the only way to tell is if it gets new growth in the spring.

It's easy...Just scrape the bark...If it is green...alive.Brown...dead.
