Common Laws are laws that have not been codified, i.e. passed by the legislature and signed into law by the governor.

Common Laws are based upon court decisions or customs and usages. If something "has alwasy been done this way," it could be considered common law. But common law is alwasy superceded by statutary law.

The common law is there, and has been there since before North Carolina became a state. Take a look at any of the excellent books on Anglo-American Jurisprudence.

NC does not recognize "common law" marriages...
I am a native of NC and have lived here all of my life..48 years...
