we are gay not working in the same dept but we are told we cant take our holidays at the same time im sure this cant be right??

Is there no possibility that one of you can apply for a different holiday period so that you both get the same periods? If not, tell your employers what you think of them, and remember it the next time they ask either of you to do them a favour by changing rest days or whatever ! ! !

In the UK your employer has the right to refuse your request to take leave if there are operational reasons. You would need to know the reason for denying your individual holiday requests before deciding whether this is discrimination. If it seems this is a case of discrimination, ie he has specifically said you two may not holiday at the same time, then see your Union or your local lesbian and gay organisation for advice.

I wouldnt have thought that they could do this if you're in completely different departments altogether. I suggest you contact a workers union. Also how many staff can have holidays at the same time in your department & also your partners department, if more than 1 of you can have holidays the same time then that might help, for example if no one else in either departments have holidays on that date & you can have more than 1 off then you know that your boss may be being prejudice. You would need to find out what is the reason given by your employer, there might be a legitimate explanation. I observed that you stated that you are gay, are you implying that it is because of your lifestyle that you are being discriminated against, if this is so, then your employer is wrong and you should get some advice on your rights in this matter

It depends upon what it says in your terms and condition/contract for holidays.
If it says that 2 people working in the same or different departments cant take holidays at the same time then thats the way it is.
Its worth checking your terms and conditions.

No He cannot. The only way he can stop you & your partner is that either one does not have anyone to cover for the other while out & IF not having one of you places a dramatic stress on the company. For more info, go on the employee rights acts Dept of labor.

Yes. Denying time off at the same time is not against the law by itself. It is legal unless you can find some other proof that it is being denied because of discrimination. For ex: Did your employer say you can never have your holidays at the same time? Did he/she say why?

On what basis are they taking this decision? Ask them to qualify why you are not allowed off work together in writing. If they refuse or if they qualify it but there are flagrant breaches by other non-partnered members of staff then I should seek legal advice.

You'll probably find that once you ask for reasons in writing the situation will miraculously change.

If your employer feels that your job or your partners job requires you to stay at work, then they can say no to one or the other. But........morally and more importantly ..... Legally, they cannot say no to you based on your sexual preference. If you think this is the reason, then both of you go talk to him and if your employer confirms this then I'd be taking it to the labour board.

It can be right and is not necessarily homophobic. There may be no holiday slots left at the time you chose. Try another date.
If there is no good reason get another job and take the ba-tard to court.
