My company has a rule book and has procedures to follow for laying someone off, or so I thought, If they dont go through on their procedures to fire someone, like warning, writeup, then suspension, then fired, Do I have a wrongfull termination case, my job is in Texas? Ive never been written up or suspended, but I do miss sometimes but never over their limit, plus their mostly for doctors visits.

It depends, if you know your company fired you instead of laying you off to save on pention money, than you should pursue the matter. If not, than you were fired, people get fired all the time without any warning. I've been fired for skipping work for not being able to make the 60 mile drive because of a blizzard. They had a write up schedule they didn't follow either. Anyway, enjoy the time off while you have it! For a couple days just sleep in, watch tv all day, and think about how much that job sucked anyway. Then start looking for a better job.

Many companies have a rule somewhere in their handbooks that says something like "employee may be terminated at any time with or without cause" This protects them from wrongful termination suits. If that's not in the book then you probably have grounds. Many companies also have a rule about having a note from the doctor if you want an excused absence.

check the labor board or the coprporate manager and read the guidlines to them and let them know what is going on and have your doctor slips handy and show them
