i was dead stopped and a truck totaled my car from the back. he told the cop he was looking down.i went to the hospital and they realeased me after taking xrays and a cat scan. can i sue if i dont have any seriouse physical injury?

You still have property damage so I would say yes you can still sue

Every state has different laws.
Do you have insurance? I'm guessing not. Yes, you can sue for damages (to your car), but keep in mind that injuries may take some time to develop (usually the next day). Did the cop take a police report? That's public record, go get a copy of it. But you may not need to sue....the other guy might have insurance so contact them.

Tell you what, if you've never, ever, looked away from the road when driving, then sue away! Otherwise, grow up and accept the accident at face value. That's why God made insurance!

Yes you can. I would make sure nothing is wrong this happened to me and I ended up with back pain at first it wasn't bad but, it got worse. This happened because I over compinsated for the pain and ended up making a bigger problem. So don't sign off on anything until you are sure.

Its too early to tell about physical injuries but you can sue for damaging your car.

Your vehicle was damaged so yes you suffered a loss and that is reason to sue. Better yet, let your insurance company handle the matter. That is their job.

Yes, absolutely! You need a lawyer, I'd give you the name of mine, but he's dead! An ambulance backed over him last week. Use the phone book.

at least for the damage to your car--why should it go on your insurance? it should come out of the truck drivers ins. co. also for your pain and suffering, the hosp visit and the doctor at the hosp. there-[they are separate bills]
