Of course you can take her to small claims court. But SSI is not garnishable, so even if you won a judgment, the court could not force her to pay unless she became employed.

If the amount is large enough, I would still take her to court just to win the judgment. Then if she ever did get a job, her wages could be attached.

If the amount is small, I doubt if I would bother.

Now, you may be able to intimidate her into paying by threatening court action, but if she knows the law this will be ineffective.

You may have other recourses if the situation warrants...For example if she signed a contract or pledged some collateral.

the court system doesn't care where a debtor gets their (legal) money from. If you can prove a debt, you can go to small claims court. You may have to take payments, but you will have the judgement should the persons circumstances change (get a job) you need to check what the limits are in you county and have good paperwork.
Hey, Judge Judy etc. may be a good option and it won't cost you anything. I am not being a wise guy about this. they tape a show for everyday and have to have cases!!!

Can you prove she owes you money? Do you have anything signed. The burden of proof will be on you to prove she owes you money.

Regardless if she is on SSI or Welfare or just broke you can take anyone to court regardless of there financially ability.

Let her go, why do you think she got SSI, not to sharp, but you may not be too sharp either. Why did you give her money?
