I have a friend who has a protective order against him?
...and his wife who put the order against him only allows him to communicate with her regarding the welfare of the child only. She also filed for divorce. The other day, my friend left the coffee house where the visitation exchange takes place. She left too. My friend returned a moment later to order some milk for his kid. She walks back in and stands behind my friend (who has the PO) to order something. My friend walked right out with his kid immediately to aviod any confrontation/communication. My friend wants an opinion as to what is going on. Also, is there anyone with similar circumstances and if there are, what is likelihood of the restraining order being lifted, how many months in your experience?

Once you have a restraining order it is indefinitely unless you can go to the court and ask them to have the other person lift it, which is still the other persons decision. You may be able to get some free counseling from one of your local Lawyers.

The thing about restraining orders is that she since she is the one who filed it can have it removed anytime. She has to do the process in reverse. Just cause they were in the same place at the same time does not mean that he will get into trouble. He would if she was to call the cops and say that he showed up there but would hope that she would not if it was just one of those things. Usually restraining orders are put in place for the safety of whom is ordering it. It was probably one of those things that happen that day, I would not worry. Maybe next time just use better judgement as to if you meet there how about going to another store to get what you need instead of the same place the kids were exchanged.

Sounds to me like she is violating her own protection order , which unfortunately even though she went there behind him he would be the one to go to jail even though she was the one violating it. I would call the county attorney and address the situation and let them know what she is doing but in the mean time dint let her trap him in a situation like she was in the coffee house. The county attorney will check into your friends citation and maybe it will get better from there.

maybe she was doing this to see if something would happen so she could keep the order in place. ie having the kid with someone irresponsible (not saying the friend is irresponsible) is the woman vindictive and try to push people's buttons. if so that may be the case.

the restraining order can be lifted any time by the wife.

I think it depends on the judge, unless she drops the PO.

well, i live in ohio and if your friends "wife" has a prtection order against him and he is caught around her , they can both go to jail so he needs to avoid her at all costs .
