My sister was married 5 years, her husband had a savings account in his name, this was a second marriage for both, After he died she found out that his kids cleaned out the account before he had died, is she entitled to any of that money, it was about $200,000...Thanks for your help

Depends. What name, or names, was on the account? If it was just his, how were the kids able to drain it? This is something best left to an attorney to go over with her, not us here.

She is entitled to it if she was legally married to him. You did not say how the kids got the money out. If they did it illegally she would have alert the bank or authorities. If they had access legally she is screwed. She will however have a problem proving they took it and her husband didn't just give it to them since he was not dead yet. You need to give more info here.

If the account was in just his name he probably wanted it to go to his kids

Is money worth someones life?? If they were his kids than they are entitled to it.

Not entitled to any of it unless he willed it to her. And if the kids were listed as joint account holders she is SOL!

She needs to get a lawyer and sue or have them prosecuted.
