I have been divorced for about 8 years and the judge makes my ex pay only $25 a month for child support since he didnt have a job when we divorced. Whenever he gets a new job I inform child support enforcement so they will raise the amount he has to pay. Whenever he finds out they are going to raise it, he quits his job so he stays at $25 a month because he has no income. This has been going on for 8 years. I have taken it to court and the judge never does anything. We've hired lawyers and still nothing changes. What can I do to get him to pay up. This is ridiculous.

The judge also told me that I can't keep my son from him. He doesn't have to pay, but I have to allow him to see him. If I don't I am in contempt.
What is sad is he believes he is a good father although he doesnt do anything for him. He'll sometimes get him a birthday or Christmas gift so he thinks that makes him a teriffic dad.
He even went as far as to ask if I will let him claim him on taxes so he can get the extra money. My son lives with me full-time. I am not allowing him to claim him. He thinks I am wrong for even ASKING for child support since he pays his $25. If that is what is in the child support paper he believes that he is doing the right thing by only paying that. He hops from girlfriend to girlfriend to have someone to support him until they get tired of it. Then he is off to the next. I don't like my son around that.

of course he thinks he's doing the right thing by paying only 25, because he has no clue what it costs to raise a child. ridiculous is an understatement, he is out of control.

and todays courts are supposed to go by a minimum wage amount if the payment is too low.

well the honor system doesnt work, thats been proven. and the quiting jobs all the time, his tax returns would reflect that and the job bouncing. it would also show what he is capable of earning, so ask it be looked at by the FEDS and AG.

i would report this whole case to your states Regional FEDERAL Child Support Office and your states Attorney General.

write a letter; in it give your contact info, case number, his info, and the problem. ask them what they are doing about it. tell them his tax returns would clearly show his job bouncing to avoid child support. he has income, he just hides it. ask why state and federal laws are not being applied to this case. ask why minimum wage job at 40 hours isnt being applied. ask for a review hearing.

with that ONE letter, FAX it to the following
1) your states Attorney General (link is below)
2) your states Regional FEDERAL Child Support Office (link is below)

phone calls are useless; they are ignored, denied and forgotten. mail ends up in someones "to do" pile, but FAXING is effective. its proof it was sent and proof they recieved it. therefor, they HAVE to address it. if you ever cant find a fax number (most are listed online), then just call and ask for it.

if you hear nothing in a week, fax it again. fax it weekly if need be. dont take no for an answer.

i would also report his *** to the IRS for working under the table (then he has to prove to them how he is living if he has no wages).

This man will not have a "change of heart" on this issue, no matter what sort of legal tricks or plees of fairness you might try. He is basically concerned about number one (himself).
So now you have to do two things:
1. Realise the toll this is having on your life by constantingly worrying about it and being angry. Yes you have a right to be angry, but you have to start releasing the issue before your health is affected. Both a christian and a doctor can tell you that anger, unforgiveness and stress of this magnitude will have detrimental effects, including heart disease, cancer, etc. The body releases toxins when you are angry. It will also affect your personality and drive your friends away, perhaps even effect your current or future relationships.
2. The main thing is your son. He needs to know how much you love him and that he is not just a bargaining chip to get more money. Even though your ex may not be the best example of a father, your son still needs his love and acceptance. How does your son feel about your anger towards his dad? Your son needs to know that you arent happy about the situation, but pursuit money is not the main thing in life -- otherwise he might grow up to be like his dad. Stop giving your money away to your lawyers and give it to someone who can help you and your son find peace and happiness again, no matter how dark the storm clouds.

I don't know what is wrong with your lawyer and the judge .
in South Carolina the Judges look at the best paying job he ever had and base the child support on that .If he was able to do it once he can do it again .It is based on that rather then what he wants to do ..He is cheating his child .
But what ever you do Do not go in to contempt of court ,you stick to the paper.Just be patient the child will grow up and see what his father is on his own .
And you will find a good man to be his step father .

He must be very bitter and twisted. Goodness, it's about his children, he is risking any ongoing relationship with them and it they who are ultimately hurt by his mean spirited actions. It might be impossible but try to appeal to his sense of love and loyalty to the child or children. Don't try to ruin the man and tell him so, just say you want his children to have advantages that they don't have now because $25 is not enough. It sounds like your doing all the right things in the courts except maybe it is costing you more for lawyers that is wise.

If the man is umemployed he has to pay 20-25 % of minium wage. that's what the lawyers told me. you need to get another lawyer doesn't sound like they want to help. If you call the attorney generals office and he is behind on his child support they will arrest him and he can go to jail. The thing is you will not get any support from him so don't let him see the kids. He helped you make them he needs to help you support them.

Talk to a lawyer and see what you can do. but as long as he keeps quiting his job and staying with $25, I really don't think that they can do anything . but try talking with your lawyer. I hope you get more and don't give up hope.
