I don't think so. They usually will give you a rain check.

This is a tricky question. If the ad states limited quantities, then no you can not sue them. If the ad just states, for example, 19 inch TV, $79.99, and they do not have it and try to pressure you into a higher priced model, that is bait and switch which is illegal and you can sue. If they out of an item, that is not limited quantities, and refuse to give you a rain check for that item, you can sue,bait and switch again. Lastly, if you receive a rain check, and the item never comes into the store, you can sue again,if the store will not give you something comparable for the same price, under bait and switch again. No. There is never an implication that a store has an endless supply of the product on sale.

In fact, the reason why the item is on sale is that it's either discontinued, an older model, line, fashion, etc. or it just didn't sell well at full-retail price, and they are trying to deplete the stock.

It's first come, first serve!

It's tough - I think you would need to prove intent. If the store had expected a shipment that never came - I don't think you'd have a case.

no, but you can request a rain check as long as the sale advertisement doesn't say "while supplies last"...

no..most stores offer rain checks....or thier ad might have said while supplys last...or limited quanities...good luck
