hi,
i recently separated from my husband 6 months ago, we are only married thru court only. I am going to file for child support, we have two kids, but i already file taxes on my own (head of household), he gives me $ everyother week & see's the kids everyother week, and picks them up from school everyday. So my question is this, im going to pay him back for filling without him?

better do an amended 1040; you can't file head of household if you are legally married; forget him the IRS will be after you

Since you're separated, I hope you filed under "married but separated." It's perfect legal to do that.

If the money is used for the good of the kids.......that should be pay back enough.........if you get them "stuff" you could tell them it's from you both
