Okay so in Jan 07 two cops showed up to my apartment and searched it. not knowing really what was going on bc i was at work, i talked to the cops and they said they were looking for one of our friends and someone told them she stayed at out place but she didnt. well she was not there at the time so they said i had 30 min to find her and have her back at the apt or we would all be arrested. they would never tell me why they were looking for her. so never the less i called around and found her w/ my other roommate and told them to go back.they ripped up our whole apt making damages to furniture and other belongings. they took a whole bunch of wierd stuff then they left not arresting her or anything but said we got off easy bc they should be taking all of us in. so things went fine for a while till about a week ago when we found out there was a warrant for the girl and then just the other day two other cops came with warrant round up for the girl and they busted in & again ripped apt HELP

a little more-- so when they came back the 2nd time we said she wasnt there and she really hadnt been there since the 1st nor had we had any kind of contact since. well they said they could come in with arrest warrant and so they came in and ripped up are place again and found no evidince that she had been there. well today she was put in jail, should i be worried could we be in trouble. also her mother now is trying to press charges on us since the daughter was convicted in our apt can she do something like that? we still dont know why she was arrested but were guessing it was something with drugs or money.

no she truly was arrested her mother called screaming at me that she wanted my parents number and address as well as my roommates. she was screaming that she was gunna make our parents go through the same thing and i would not give her the info so she said dont worry i will be seeing you!

Why did you let them search without a warrant, the first time?

Sue the police department. If the Cops came into your house searching for a person, even with a search warrant, they can only search where that person may be able to hide. If they were tossing drawers to a dresser or other such furniture then you have a very good case for a violation of your 4th Amendment rights,"... to be secure in your persons, houses, papers, and effects against unreasonable searches..."

I didn't read the entire question you posed but I skimmed through it that is why I was pretty vague. Simply put if the officers ever touched one thing that the person could not have hid in then they were in the wrong with or without a warrant.

I would contact an attorney , this does not seem to be a reasonable search ,and seizure...but in the mean time always be sure you truly know the people you allow in your home..I have family that I do not allow on my property , because of their habits and previous history , If they had a warrant to search for a certain item then it would justify their actions and no they do not have to clean it up .. I would consult an Attorney to be sure this is not harassment , or over stepping the boundaries of the warrant. If they were just looking for her only , then they should not be turning over furniture, and tearing up the place.. if someone gave consent to enter and opened the door , it seems they were not being very professional . depending on what they were looking for .and the circumstances..but on the limited information given sounds like they were out of line ..

Are you sure they are really police officers? Could be getting ripped-off for all you know. Did they actually take her in or not.????
