Last spring, I was hit by a driver who was being chased by the police. He managed to cause some pretty bad cosmetic damage to my vehicle and thankfully nobody was hurt. My insurance couldn't do anything because I only have liability on my vehicle and the vehicle that hit me was stolen. I have to go to court over this in March (almost a year later). What are the chances of me actually getting money to get my vehicle fixed?

Yes, I did something similar a few years ago, someone hit a deer, I went around on the freeway, someone else behind - sped up not slow down, swerved and hit my passanger door, totaled the car, it took two years but we got the money, we just had to wait for the unemployed slug to get a job, once he got a job and filed his taxes, we got the refund...

I think that all depends on whether or not the driver that you are suing has any money? Proving that it was his fault is easy, but actually getting the cash if you win is tough because he may not have any money or a job where his salary can be garnished.

I would first see what your local laws reguarding damages during a police chase are. Usually, they will pay for incidental damage to the innocent. If not, I would sue the guy who ran from the cops....it was his fault that it happened.

First go to the District Attorney and file for victim restitution. The person who hit you will have to pay restitution if given probation or parole but you have to ask for it. If you do not have restitution in your state sue the person who hit you.

As for suing the cops they were doing their job. If you want to sink to the level of the criminal who hit you then go ahead and sue the cops.
