My son had to get stitches after a metal shelf fell on his head. We don;t want to sue or anything, but how do you get them to pay the bill?

nyogi, thanks. yes we did file a report with the store at the time....my son was bleeding all over the floor.
I hope they just pay the ER bill. It probably won;t be that much, my boy is ok now, he just has a cut on his head.

Your best bet would be to file a lawsuit.

When this accident happened, did you report it to store management? If you just took your injured child and left the store without making a report, that sounds like a problem. If you come back there a week later and say my child was injured here on the 23rd, here is the bill, they might think you are a fraud.
If you DID report the accident, you could ask them to pay the medical bills without bringing suit, but if you don't get a PROMPT response, I would see a lawyer. I don't know how much this all is costing you, but if you go easy on Wal-Mart, you could run out of time to exercise the legal option.

You do not necessarily need an attorney, many people do things like this every day! Because a report was made and your son did have a injury, and attend a hospital, Walmart's insurance should already have a claim filed, including a claim # and adjuster.---You can speak with an attorney and get advice, but if you have a straight foward case (like, no dobt your son was injured ther) you should be able to do it alone-- Be sure to have your child checked out by a chiropractor, always a good idea I say-- And, 1 more thing-- when attemting to setlle with the insurance company always ask for atleast double your medical bills as compensation--if they give you a bad offer dont be afraid to tell them you atty will contact them ( atty's dont collect untill you get paid! davisbrittany85@yahoo.com -e-mail with any more questions, this is my job!
