Four years ago we moved into our house, having taken out an Indemnity policy for lack of planning and building regulations on a small extension. We have now discovered that we have no foundations or footings to this extension. Will this policy cover us to have these works carried out? Legal advice much appreciated.

I'm afraid the policy is unlikely to assist you.

The purpose of the policy is probably to cover against the instance of enforcement action by planning authorities not actual defects in the work itself. It is designed to give you, your mortgage lender and any prospective purchaser from you comfort only.

Look carefully at the wording of the policy however in the absence of possible misrepresentation in the sale to you this could be something you are saddled with.

Did you have a full survey? Should your surveyor have spotted this?
