What are the rules for child support overpayments in Florida?

I just found out that my ex-husband overpaid me in child support. He received a letter telling him he was behind, however when he went to the child support office he found out he was actually in the plus. He told them that he did not want them to make me pay it back. Will my payments stop or be reduced until the overpayment amount is satisfied?

If he overpaid his payment might just be reduced until he is back to $0. Don't spend it frivolously because it is not extra, it is just overpaid. Don't give it back because he is not concerned and it would complicate things at the support office. Just look at it as an advance and use it wisely! My husbands tax refund overpaid his account too (how, I do not know) so it just means he can miss a few payments (we are self-employed and pay it every week ourselves.)

YOU should be HONEST and HONORABLE and send him the money back until the overpayment is repaid. You know you've been paid more than you are due.

Do the right thing and return his money to him!
