When divorcing your husband in the military, what are common things to ask for? Do I get his BAH? How much will I get for child support and will I get spousal support if I have not worked for our whole marriage and was a stay at home mom?

The military only allows for so much, depending on the length of the marriage. My marriage was 15 years, and I automatically get 50% of his military retirement. After so long, the soldier has no say in that.

You probably get the BAH, but not any additional child support or spousal support.

Your best bet is to contact the state you are from, and file from divorce there. You are a resident of that state, and you should abide by their laws. If that state says he owes (for instance) $100/month child support, the military may only say he owes $50. The state of record is what he will owe, even if he is not forced to pay that amount at that time.

You should, at a minimum, ask that he pay 100% of all medical/dental and counseling for the children, keep the SGLI in YOUR name, to benefit the minor children.

I would also put in there that if he is scheduled to have the children for holidays, but he is scheduled to be gone somewhere, that YOU get the children, that he does not have the right to send them to someone else.

ITs baq and its only till your divorce is final they base child support on his income which it would be based on his baq you will not get spousal support if you have not been married long or have had a job during your marriage and if you get it then that depends on how long the judge decides you can have it sometimes its 6 months sometimes its longer, it depends on how long you have been married i need more info if you have been married over 10 years technically you would be entitled to half his retirement if he was too retire.
