Neighbor wont cut tree away from my house which is causing damage to my property. Any good lawyers or advise?

What you have here is tree encroachment. You should call your lawyer for advice, but generally if the tree is right on the property line, you both own it and you will have a fight on your hands unless the other owner also agrees to trimming.

Now if the tree (that being the trunk) is on your neighbor's land, and the limbs are damaging your home, you have the right to trim them to stop the damage.

I don't know where you live, but I have added a link to use for precedence if you need it. Call your lawyer and have him draft a letter to your neighbor explaining that damage from his tree will affect his wallet.

It is your neighbors responsability to trim the tree if it is blocking light to your property or over hanging on your property and touching your home. You also have the right to trim the tree back yourself to your neighbors property line. If the tree damages your home in anyway then it is your neighbors insurance company that will pay for the damage. If he has insurance :)

Small claims court is the only thing that I can think of, if they have to pay some damages then they may think twice about cutting some of the tree so it won't fall on your house.

Your neighbor is responsible for damage done to your property ( including structures ) caused by his tree. If he won't tend to it you can take him to court and sue for damages.

if it overhangs your property you can cut down the part legally that overhangs. but be prepared for the neighbor to become petty. don't place the ladder in their property.
