I am no lawyer, but I think that should work...having said that...she needs to find a lawyer cos obviously, her hubby wont take the divorce part easily so she needs someone who knows what they are talking about standing behind her. Even if she thinks lawyers are too expensive (which they are) she doesn't necessarily have to hire one, just consult with him...cos whatever you will pay for the lawyer, it is still better than being robbed of everything (or at least half). Good luck!

Not if the children are under 18 years of age. And he cannot take everything it has to be divided fairly. But that is anything they got together during the marriage. Anything she had before the marriage is hers. She needs to contact a lawyer as soon as possible. This guy she is divorcing is going to make things difficult.

She has to meet with an attorney. Sometimes things vary by state, but most likely he will not be able to take everything. That is just a scare tactic to try and get her not to leave. Attorneys do consultations and that would be her best bet...

In the US, things are split down the middle, and it's called community property. If her logic worked, he could sign everything over to his parents or friends and she'd get nothing. The courts will decide who gets what.

If he works and she stays at home with the kids, she will be taken care of. He can't take everything from her. If they have minor children at home and she gets custody, she will probaby get the house, child support and maybe alimony. Tell her to get a good attorney.

your friend needs to consult with a divorce lawyer, that is where she will get the best answers that are in accordance with the law, she doesn't want to go and do something that will hurt her when(if) she goes through with the divorce

If she is serious about getting a divorce, she needs to see an attorney (but not tell him about it). An experienced divorce attorney will be able to answer all these questions and help her protect herself in a divorce.

It sounds like she needs to contact an attorney and get some legal advice. They won't charge her to just answer some questions and give her some advice.

in a divorce, the judge decides who gets what. she can't have her things signed over to one of her kids. if everything is in her name , she will get the majority of the things. have her talk to a lawyer.
