after calling 911 (themselves). Once admitted to the hospital ICU, they quickly stablize and want to leave. Do you think criminal charges should be pressed against them if they leave Against Medical Advice? I have my own opinion, but I'm curious what other people think. In your answer, let me know in what field you work or study, please.

This isn't about ME. We had this happen at my hospital and I was wondering what others would think.
People are NOT always HELD for 24-48 hours. That depends on facility policy and who you know.

Yes and they should not be released until they have gone through a thorough mental examination and counseled by professionals to find out exactly what the problem is. Time does heal all.

I do not think criminal charges should, or would, be filed against someone leaving the hospital against medical advice. However, leaving against medical advice does bring in to question the person's mental health as to whether or not they are a risk of harm to themselves or others. This is one of the criteria for an involuntary forced hospital stay for mental health examination. Given that this "someone" has attempted suicide I believe a strong case could be made for a forced mental health examination. This is not a criminal matter but clearly further examination would be very prudent.

Criminal charges for attempted suicide?

Why not a mandatory death sentence while you're at it?

Honestly, suicide is a private matter, and judges should not be brought into that, the same way they have no business what happens in the privacy of the home between consenting adults. And dorctors are not God that their recommendations should be given legal sanction.

On the other hand, costs incurred in saving the person... yeah, he or his estate might be sued for those, even, or especially, if they were paid by the community at large (public social security type health insurance).

In a situation like this, the hospital would probably move to have the patient held against their will. A "502" could be signed by the attending doctor. A patient would not be released if medically he/she was a danger to him/herself or others.

Just think of the lawsuit if the patient was allowed to leave and then proceeded in a "successful" suicide attempt.

They are generally not allowed to leave. Most are sent up to the psych ward for 24-48 hours for observation to see if they are still a danger to themselves or someone else. If they are, they are held longer.

What criminal charges should be filed, drug possesion, attempted murder or falsely summonings an ambulance?

No I do not think criminal charges should be filed. I think they should be held for 72 hours in the phsyc ward.

Criminal charges will only serve to punish someone who is very sick emotionally. Attempted suicide is a cry for help. They need counseling and treatment, not criminal charges.

In Vermont, if you admit to attempting suicide and don't want to go to a psych ward, they can arrest you for attempted murder(self).
