when they make nintendo DS games, the games themselves are programmed to use the touch screen
when they make gameboy advance games, they do not program the games to use the touch screen, because if they did, and the game was played in a gameboy advance system, that programming would do nothing
it is the GAME, not the system, that determines if a game uses the touchscreen. there are DS games that don't use the touchscreen. mario: partners in time only uses the touch screen once, that i remember.
also, the DS has two game engines, one for the GBA and one for the DS. the DS engine has connectivity to the receptors on the screen. the gba engine doesn't.

Well, in theory, the touch screen could work with GBA games. The only problem is none have been programmed to use the touch screen yet. Some games do have extra functionality for the ds though. Like Warioware Twisted! can talk to Warioware Touched!. There are a few others like those two, but I can't remember any off the top of my head. So to answer your question, yes GBA games can use the touch screen, but no, none of them do.

The touch screen doesn't work with GBA games. Remember the GBA came out first, so they can't just make them all compatible with the DS. Also the touch screen IS supposed to be off, unless you have the settings changed so the GBA game screen is on the bottom.
