Never drink from any open containers? LMAO! Yeah, only drink from closed ones.
You have to be able to provew that the drink was spiked. I know it happens but unfortunately very few drinks are ever tested and then the burdon of proof falls on the victim, while it is just as easy for a defense attorney to claim that the victim was simply drunk.

If you have proof and you know who did it, you can file a charge through the police or directly with the District Attorney's office. If you have suspicions but no proof you can still talk with the police and explain the circumstances. They may have other similar complaints or they may start an investigation.
Spiking a drink is a serious crime, not a spoof. You can expect charges ranging from aggravated assault to attempted homicide. At the very least it is reckless endagerment.
