Ok, every other morning or so if not every morning i walk to my car that i park in a parking structure, and someone has spit on my drivers side window. i have never seen anyone actually do it but If i was to catch this person red handed could i press charges? does any one have any suggestions?

Many states will vary, but in TX that would be considered "Criminal Mischief" (usually a Class C misdemeanor), due to the nature and the inconvenience of cleaning it up. I would suggest a well placed video camera, and see what happens. To many this might sound trivial, but it is an inconvience and is a criminal act. The most the person or persons will get will be a $200.00 fine, and if they have a history many some jail time??

You MUST get proof... Video tape him doing it and then press charges. If you don't get proof, I guarantee he will deny any wrong doing. That is a he said/she said thing. The burden of proof is on YOU because you are the one who is accusing. As I said, video tape it than press charges.

YEAH.... why is he spitting on your car... is he just an evil person who wants to make your life miserable... or is their a SECOND part to this story????

There's more to this story than you're telling, isn't there, Matt? Just why is someone doing this to you? What did YOU do to provoke it?

And please don't expect us to believe that you didn't do anything to anybody...I seriously doubt if someone just picked you at random to spit on your car.

So how about letting us in on the rest of the story?

park somewhere else. does he actually seek out your car or do you always park in the same place? surely u can find a place where theres a ctv camera? or just put one in your car hidden. dont you have an inkling who it is?

Contact the owner of the parking structure (why so vague?) and see if they have surveilance set up

Start documenting everything. Take pictures. Then, SUE EM!
