The photography magazines run an article on this every now and then and as I understand it, you can snap away as long as you are not on private property.

There may be an issue if you use that image for finacial gain as you may need to pay a release fee and get a release contract signed but for pictures that may be in the interests of the public, or Tom cruise wandering up and down oxford street in nothing more than speedos and a maniacal grin then I have not heard of any paprazzi paying commission.

You have a right to privacy and as such a photo is a violation of this right. If you give permission for a picture to be taken then the photographer, in the absence of any other agreement, owns the copyright of that photo and to reproduce it requires his permission. That is why wedding photographers are able to charge so much for the prints.

Yes it is legal to take the photograph if it is taken FROM a public place but it is not legal to then use it to infringe their copyrights (IE by producing & selling bootleg T-shirts, tapes, videos etc) or for purposes which might be deemed libelous or slanderous

In theory this can only be done by the police under the statutory powers of the Police and Criminal Evidence Act. In all other cases, permission should be obtained.

it depends.

accourding to european privacy law;
- it is illegal to take an upclose 'portret' picture of a person without their consent.
- It is legal however to take pictures of public area's containing people, without having to ask their consent.

so it depends on how the picture is taken. if the person is in the background you dont need permission.

yes if you are on public land such as in the street, you do NOT need permission, if it is on someones land than that's a different kettle of fish and it could well be illegal under several statutes.

Yes if they are in the street or any public place. You are not allowed to do so, if they are in their own home / garden or any other place which is not open to the general public.
