1. My wife and I married December 31, 2006.
2. I filed on my income tax return married filed jointly.
3. My wife claimed no income.
4. I received notificatioin from the IRS that my refund is offset because my wife owes child support.
5. 1/2 of my child support was taken and that hurt because before marriage I was a full time single father.
6. According to IRS I needed to file an "Injured Spouse" Claim form. Originally IRS took ALL of my refund but they did give me half.
7. According to IRS I need to file this "Injured Spouse Form" every year.
8. How can I get around this?
9. I feel like my wife debt before marriage has nothing to do with me.
10. Please advise.

they are right, when you marry, you take on all of it. and she knew you had children, pay child support. maybe she didnt know you owe THOUSANDS in arrears, but she does now.

in order for the IRS to even take it, is if its been submitted by the state child support dept for tax refund intercept. and they cant do that unless you owe THOUSANDS of dollars in arrears.

just file what the IRS told you to. they explained it to you.

Your wife's debt BEFORE marriage is now your debt as well!! Just the way it works!

Once you marry your finances are shared. Anything debts or liability she incurs are yours. Any debts you run up she is equally responsible for.

I'm sorry you should have know that your wife's debt is your debt. You wife's problems are your problems.
